This Privacy Policy (“Policy”) describes how Okela, Inc. (“Okela,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you use the Okela mobile applications, including Okela (for consumers) and Okela for Business (for merchants), and any related services, websites, or software (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree, you must not use the Services.

1. Information We Collect

Okela collects personal and non-personal information necessary to operate, improve, and provide the Services effectively. The types of information we collect include:

1.1. Information You Provide

  • Account Information: Your name, phone number, and any profile information you choose to provide, such as a profile image or business name.
  • Merchant Information: For business profiles, we may collect store details such as name, address, logo, images, and contact information.
  • Transaction Data: Details about your interactions with merchants, including points earned, rewards redeemed, and transaction history.
  • Communications: Information you provide when contacting us, submitting feedback, or reporting issues.
  • Optional Profile Data: Users may upload an image or update their name within their profile settings.

1.2. Information We Collect Automatically

  • Device Information: Details about your device, including IP address, browser type, operating system, and other technical information.
  • Usage Data: Information about how you use the Services, such as pages visited, features used, and session duration.
  • Location Data: If you choose to share your location, we may collect precise location information to enhance your experience.
  • Cookies and Similar Technologies: We use cookies and similar technologies to track your preferences and improve your experience.

1.3. Information from Third Parties

We may receive information from third-party service providers that help us verify your identity or authenticate your account. For example, phone number verification and OTP authentication are provided through Prelude, which processes your number to deliver verification codes.

1.4. Purchase and Reward Information

When you earn or redeem points through Okela, we may collect details such as:

  • Store name and location;
  • Date and time of the transaction;
  • Points earned or redeemed; and
  • Associated user or merchant identifiers.

We do not collect payment card data or process payments of any kind.

2. How We Use Your Information

Okela uses the information we collect to operate, maintain, and improve the Services, communicate with you, and comply with legal requirements.

Specifically, we use personal information to:

  • Create and authenticate user and merchant accounts;
  • Operate and maintain the rewards and loyalty platform;
  • Provide customer and merchant support;
  • Communicate important notices, including policy updates or security alerts;
  • Analyze usage trends to improve performance and user experience; and
  • Comply with legal obligations and enforce our Terms of Service.

We do not sell your personal information to third parties.

3. How We Share Information

We limit the sharing of personal information and disclose it only as reasonably necessary to provide the Services or comply with the law.

We may share information with:

  • Service Providers: Trusted vendors who perform services on our behalf, such as authentication (Prelude) and database hosting (Supabase).
  • Merchants: When you earn or redeem points, relevant details (such as transaction date, store, and points) may be shared with the corresponding merchant.
  • Legal and Safety Obligations: When required by law or to protect the rights, property, or safety of Okela, our users, or others.
  • Business Transfers: In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction.

We do not share user data for advertising or marketing purposes unrelated to the Services.

4. Data Retention

We retain personal information only as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, or enforce agreements.

When information is no longer required, we securely delete or anonymize it.

5. Data Security

We implement appropriate technical and organizational measures to protect your information from unauthorized access, alteration, disclosure, or destruction. These measures include encryption, secure authentication, and access controls.

However, no method of transmission or storage is completely secure. You acknowledge that use of the Services involves inherent security risks.

6. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights with respect to your personal data, including:

  • Access: You may request a copy of the information we hold about you.
  • Correction: You may update or correct inaccurate information through your account settings.
  • Deletion: You may request deletion of your account and associated data, subject to legal or legitimate business requirements.
  • Withdrawal of Consent: You may withdraw consent where processing is based on consent (for example, marketing communications).

7. Children’s Privacy

The Services are not directed toward children under thirteen (13) years of age, and we do not knowingly collect personal information from children under this age.

If we become aware that we have inadvertently collected data from a child under thirteen, we will promptly delete such information.

8. International Data Transfers

Okela currently operates within the United States. Information collected through the Services is processed and stored in the United States and subject to U.S. law.

If you access the Services from outside the United States, you consent to the transfer and processing of your information in the United States.

9. Third-Party Links and Integrations

The Services may contain links to third-party websites or services not owned or controlled by Okela.

We are not responsible for the privacy practices or content of such third-party sites. Your interactions with any third-party service are governed by their respective privacy policies.

10. Changes to This Privacy Policy

We may modify this Privacy Policy at any time. When changes are made, we will update the “Last Updated” date above and, where appropriate, provide additional notice (such as in-app alerts or email).

Your continued use of the Services after such updates constitutes acceptance of the revised Policy.
